Public Offer

Public offer to conclude a contract for the paid provision of a house for temporary accommodation at the Ozernaya 38 holiday cottages (the “Offer”).

1. Definitions

• Service provider — Self-employed (NPD taxpayer) Glazov V. A., Taxpayer ID (INN) 780439424609.
• Customer — a legally capable individual who has made a booking for themselves and/or other persons.
• Guests — persons who stay in the house together with the Customer or in the Customer’s place.
• Property — the house at the Ozernaya 38 holiday cottages (Priozersky District, Leningrad Region, Lake Sudakovskoye) chosen by the Customer.
• Booking module — the online booking form of the Bnovo service embedded in the website.
• Booking confirmation — a message from the Service provider or the Booking module stating the Property, dates, price and payment terms.

2. General provisions

2.1. This document is a public offer under Article 437 of the Civil Code of the Russian Federation. The Offer is accepted by making a booking in the Booking module, or by phone with subsequent confirmation, and/or by paying a deposit. From the moment of acceptance the contract is deemed concluded.

2.2. The Offer is valid from the moment it is published on the website until it is withdrawn or amended by the Service provider. Amendments apply to bookings made after they are published.

3. Subject of the contract

The Service provider provides the Customer and the Guests with the Property for temporary accommodation during the period stated in the Booking confirmation, and the Customer pays for the services on the terms stated in the Booking module and the Booking confirmation.

4. Booking procedure

• The Customer chooses the Property and dates in the Booking module, provides accurate contact details and the number of Guests, and confirms the booking.
• The number of Guests must not exceed the number of sleeping places stated for the chosen Property.
• The Service provider confirms the booking in the manner provided by the Booking module or contacts the Customer using the details provided.
• Personal data is processed in accordance with the Privacy Policy.

5. Price and payment

5.1. The price of the stay is stated in Russian roubles in the Booking module on the date of booking and recorded in the Booking confirmation.

5.2. The amount and deadline of any deposit, the available payment methods and the procedure for final settlement are shown in the Booking module and/or the Booking confirmation. Where a deposit is required, the booking is held for the Customer once it has been received.

6. Check-in and check-out

6.1. Check-in and check-out times are stated in the Booking confirmation or agreed by the parties by phone.

6.2. On arrival, the Customer and the Guests present an identity document at the Service provider’s request, for the purposes provided for by the legislation of the Russian Federation.

7. Changing and cancelling a booking

7.1. The Customer may ask the Service provider by phone or email to change the dates or cancel the booking. The conditions for refunding a deposit are those shown to the Customer when booking (in the Booking module) and stated in the Booking confirmation.

7.2. The Customer may withdraw from the contract on condition of paying the Service provider the expenses it has actually incurred (Article 782 of the Civil Code of the Russian Federation).

7.3. If the Service provider cannot provide the Property on the confirmed dates, it will offer an equivalent Property or refund all amounts paid by the Customer.

8. Rights and obligations of the parties

The Service provider undertakes to provide the Property in a condition fit for living and matching its description on the confirmed dates, and to give the Customer the necessary information about the conditions of stay.

The Customer and the Guests undertake to:

• pay for the services in the manner and by the deadlines stated in the Booking confirmation;
• take care of the property and the grounds, and observe public order and quiet hours;
• observe fire-safety rules, including when using the barbecue, fireplace and open fire, and never leave them unattended;
• not exceed the permitted number of Guests and not pass the Property to third parties without the Service provider’s consent;
• compensate damage caused to the Service provider’s property through the fault of the Customer or the Guests.

9. Liability

9.1. The parties are liable in accordance with the legislation of the Russian Federation, including the Law “On Protection of Consumer Rights”. Nothing in this Offer limits the Customer’s rights as a consumer.

9.2. The parties are released from liability for failure to perform obligations caused by force majeure, of which they must notify each other.

10. Claims and disputes

10.1. Claims are sent to the Service provider at oderjimny@yandex.ru or in writing and are considered within the periods established by the legislation of the Russian Federation.

10.2. Disputes are resolved through negotiation and, failing agreement, by a court in the manner provided for by the legislation of the Russian Federation.

11. Final provisions

Emails, Booking module messages and confirmations received from the Service provider are recognised as a proper means of notifying the parties. The booking conditions that the Service provider states in the Booking module and the Booking confirmation form an integral part of the contract.
